BLAINE, Wash. — A man who suffered severe injuries while sliding down a waterslide in Birch Bay in 2023 has reportedly agreed to a settlement yesterday, August 4, 2026, to resolve a lawsuit filed in Whatcom County Superior Court in 2024.
Michael Driggs, an attorney with The Advocates, told Whatcom News a $4 million settlement will be paid by Birch Bay Jun Yu Waterslides LLC, Safe Slide Restoration and Kingworks Consulting Engineers, PLLC. The 3 were defendants in the lawsuit.
Larry and his family are very happy to have the case resolved. This settlement will help provide for Larry’s future needs and allow the family to move forward.

First responders were dispatched to Birch Bay Waterslides, located at 4874 Birch Bay-Lynden Road, just before 1pm on Friday, August 25, 2023 due to a report of a patient with a traumatic injury.
According to people who said they had been onsite nearby, an adult male had sustained serious leg injuries while going down a water slide. Witnesses said an equipment failure was the cause. The water park was immediately closed for the remainder of the season.
The facility reopened to guests for the 2025 season following inspections by health department and engineering experts.
Marketing messaging early in 2026 stated the park was expecting to open for the 2026 season but during the spring, messaging on the website announced the 2026 season was canceled. The property appeared listed for sale about the same time.
Current real estate listing information shows the property remains for sale with a $6 million asking price and has an offer “pending feasibility.”
The water park initially opened in 1982.
