WSP alerts drivers – filming while driving is illegal

WHATCOM COUNTY, Wash. — Washington State Patrol reported today, March 5, 2026, at a recent collision scene, nearly 100 drivers over less than 1 hour were seen pulling out their smartphones to record the scene. This action qualifies as using a personal electronic device while driving, a traffic infraction. Citations carrying a $150 fine were sent in the mail.

    Your headline is incorrect: your reporter and editor need to do a better job at reporting with accuracy and discernment.
    Trooper Hardings’ statement is correct: holding an electric device in one’s hand while driving is not permitted. Recording a video while driving is allowed as long as it is done hands-free.
