Over the past few months, both parties have been in court and the court has issued a couple notable edicts.
- City building inspectors had been requesting the Rojszas let them inside to perform inspections and take pictures. Art and Margaret Rojsza told the court, through their lawyer, they refused pointing out the inspections had nothing to do with the interior of the structure, which had previously been inspected by a third-party and deemed satisfactory. The court found the Rojszas were right to refuse entry to the inspectors and the City was told to not make such requests again regarding the settlement agreement which is only about exterior work. Also, the court said further inspections should be done by a third-party and both parties will share the cost.
- Failure to complete mutually-agreed to items on the settlement agreement by the Rojszas sent the City back to court which in turn lead to additional attorney fees. The court granted the City’s request to have their attorney fees ($6,689) paid by the Rojszas. A payment plan through March of 2017 was recently agreed to by both parties.
On September 21st, Art Rojsza told Discover Ferndale in an email he and Margaret had recently returned from completing a project in Vancouver WA. He said, “For next few weeks there will be some action on the roof of our clock tower. We will work towards completion of metal roofing, widow walk and other, associated elements.”
On a much different and perhaps fun note, Art Rojsza informed Discover Ferndale he had recently accepted an invitation from Mayor Jon Mutchler to serve on a panel of judges to choose the top three winners of a residential Halloween best-decorated and creative home contest put on by the City.
