Lummi Island man accused of rape

A Lummi Island man has been arrested for 1st degree rape after a woman reported being raped in a cabin in the 4300 block of Matia View Drive early this morning.

The woman told deputies she had been knocked unconscious more than once during the ordeal and, while the suspect was distracted, ran out of the cabin to the landlord’s residence nearby according to a news release from the Whatcom County Sheriff’s Office.

The landlord, according to the news release, said he found the victim outside his house screaming and hysterical. He gave her ice packs for her injuries and called 9-1-1. Law enforcement and aid units were dispatched about 2am. Deputies reported she had heavy bruising on her face, chin and arms.

The victim, in her 20s, was transported by ambulance to Bellingham for treatment at PeaceHealth St Joseph Medical Center.

When deputies contacted the suspect, he told them no physical altercation had taken place. But deputies determined probable cause existed to arrest Justin Leon Brubaker, age 33, of Lummi Island for 1st degree rape and he was booked into the Whatcom County Jail early this morning. According to the news release, Brubaker listed his address as 4300 Matia View Drive.

According to jail records, Brubaker was also charged with 2nd degree assault with sexual motivation and felony harassment. Jail records indicate he remained in custody as of 4pm today.
