A handful of neighbors made their concerns known to the Hearing Examiner regarding a conditional use permit applied for by Harjit and Tony Dhaliwal to operate a extended stay facility (later named Orca Inn Suites) at 5370 Barrett Road, most recently operated as Eagle Ridge Assisted Living. The neighbors were all concerned with the proximity of the facility to their homes and several had concerns of illegal activities they associated with extended stay facilities.
After hearing citizens’ and city staff’s concerns, the Hearing Examiner granted a temporary two-year approval of the conditional use permit.
The permit requires valid licensing be obtained as well as remedying some physical aspects of the property including fencing, landscaping, parking lot lighting and increasing the number of parking lot spaces. These things are to be accomplished to the city’s satisfaction prior to the owners receiving a Ferndale business license and conducting any business on the property.
Then, in two years, the Hearing Examiner will hold another public hearing to review the temporary permit. According to the permit document, the two-year review
… is to evaluate whether the facility operates under the conditions for which it was approved and has been managed in an appropriate way to keep it from becoming a public nuisance. The review will include a review of police records associated with the property. In regard to criminal activity, the Hearing Examiner expects the management and employees to immediately report any suspected criminal activity and to take all reasonable steps to minimize or eliminate criminal activity on the site, including the installation of signing proposed.
Testimony from neighbors will also be solicited for the two-year review.
The Hearing Examiner would then refuse to extend permit approval further, extend it for a fixed time frame with another review following or permanently approve the permit.
