Bellingham businesses propose settlement in data breach class action suit

BELLINGHAM, Wash. — A proposed class action settlement has been proposed by defendants Mt. Baker Imaging, LLC and Northwest Radiologists, Inc., P.S. following a cybersecurity incident in January 2025. The incident occurred between January 20, 2025, and January 25, 2025, and was identified as a ransomware attack. This breach compromised the private information of about 340,000 individuals.

Information accessed during the incident included names, dates of birth, Social Security numbers, addresses, telephone numbers and email addresses. Protected health information was also impacted, including provider names, medical record numbers, health insurance information and treatment or diagnosis details.

Four class action lawsuits were filed in Whatcom County Superior Court following the incident. The court consolidated these actions in May of 2025. A consolidated class action complaint was filed in June of 2025, alleging negligence, breach of implied contract and violations of the Washington Consumer Protection Act.

The proposed settlement agreement establishes a $3,300,000 non-reversionary fund. This fund is intended to pay for the following.

  • reimbursement for documented out-of-pocket losses up to $5,000 per person
  • 2 years of Medical Shield Complete, a medical information protection and monitoring service
  • pro rata cash payments distributed from the remaining balance of the fund

Separate from the common fund, the defendants have agreed to invest in excess of $500,000 in cybersecurity system improvements.

A hearing for the court’s preliminary approval of the settlement is scheduled for April 17, 2026.

Once approved, a notice program will be initiated to inform class members of their rights to submit claims, object, or exclude themselves from the settlement. Class members will have 90 days from the first date of notice to submit a claim form.
