Third suspect arrested, faces robbery, assault charges in Birch Bay shootout

BIRCH BAY, Wash. — Court records filed this week shed new light on a third suspect involved in a Labor Day weekend shootout between rival motorcycle clubs outside a restaurant in Birch Bay.

An affidavit of probable cause filed September 9, 2026, in Whatcom County Superior Court details charges against 39-year-old Jereme Paul Robertson, whom law enforcement suspect to be the president of the Mongols Motorcycle Club. Robertson is accused of initiating the confrontation, attempting to disarm an opposing club member, and firing multiple rounds down a crowded street during the September 6 exchange of gunfire.

According to the affidavit, Robertson arrived outside the restaurant at about 7:20pm riding a black motorcycle featuring high “ape hanger” handlebars, a white/clear headlight, and a black motor—a bike matching photographs on Robertson’s personal Facebook profile. Robertson arrived alongside fellow Mongols-patched riders Roman Mayne De Isla Puga and Diego Uribe-Gonzalez.

Surveillance footage reviewed by Whatcom County Sheriff’s Office deputies shows Robertson leading the trio across the street to confront William Husky, who was wearing Bandido patches and walking into the restaurant with his wife. The three men surrounded Husky in an alcove, where Husky later told deputies Robertson and his companions ordered him to strip off his Bandido vest.

When Husky declared he would defend himself and drew a pistol, Robertson joined Mayne De Isla Puga and Uribe-Gonzalez in attempting to forcibly take the weapon away. During the physical struggle over the gun, Husky’s firearm discharged into Uribe-Gonzalez’s right shin.

As Husky backed away and pointed his weapon, Mayne De Isla Puga ran across the street to retrieve a firearm from his bike, while Robertson retreated toward the south end of the Bay Breeze building. Surveillance video shows Robertson brandishing a smaller handgun, believed by investigators to be a silver revolver, and returning fire toward the north. Robertson is alleged to have fired an estimated 6 rounds at Husky and his wife from roughly 20 feet away as civilian traffic, families and children passed by on the surrounding sidewalk and street.

Robertson fled the immediate scene before deputies arrived, but investigators established contact with his significant other, who had arrived in the area after Robertson phoned her to report to the scene.

Whatcom County prosecutors have formally charged Robertson on the following felony offenses.

Attempted Robbery in the First Degree (RCW 9A.56.200): for confronting Husky, demanding the surrender of his Bandido patched vest, and attempting to forcibly seize Husky’s firearm prior to its discharge.

Assault in the First Degree (RCW 9A.36.011): for leveling and discharging approximately six rounds from a handgun at Husky from a distance of roughly 20 feet.

Reckless Endangerment (RCW 9A.36.050): for discharging a firearm into a populated public corridor, placing uninvolved civilians, motorists, and bystanders at immediate risk of death or serious physical injury.

According to court records, a bench warrant was issued for Robertson’s on September 9, 2026.

Today, Friday, September 11, 2026, Whatcom County Jail records show Roberts was booked into the jail about 3:40pm.

As of today, no bail was being offered. Bail, if any, will likely be set during an initial arraignment hearing.
