BIRCH BAY, Wash. — Documents filed in court cases in Whatcom County Superior Court provide details surrounding a shooting incident on Birch Bay Drive on Sunday, September 6, 2026.
According to affidavits of probable cause filed by the Whatcom County Prosecuting Attorney’s Office in Whatcom County Superior Court on September 8, 2026, the incident occurred outside a restaurant.
Surveillance video showed multiple individuals wearing vests displaying “Mongols” patches arrive on motorcycles at about 7:20pm and park across the street from the business. William Stephen Huskey, 54, appears on foot wearing a vest displaying “Bandito” patches and walked past the business with a female.
According to the affidavit, the group crossed the street, surrounded Huskey and the female outside the business and initiated a confrontation. Huskey told law enforcement officers that the group told him to remove his patches.

Huskey told law enforcement officers he stated he would defend himself. A struggle occurred and the video showed Huskey draw a handgun and point it at an individual. An individual dropped to the ground with a gunshot wound to the foot.
Video showed Huskey point the firearm toward other individuals. Roman Mayne De Isla Puga, 31, retreated across Birch Bay Drive to a motorcycle, retrieved a firearm from a compartment on the vehicle and fired toward Huskey. A second unidentified individual also fired toward Huskey.
Mayne De Isla Puga then crossed Birch Bay Drive and moved toward Huskey while firing. Huskey ran north and fired toward the group. Multiple shell casings were recovered from the roadway, and bullet strikes were located on residential units.
Officers and deputies stopped Mayne De Isla Puga on Birch Bay Lynden Road at about 8:20pm. Mayne De Isla Puga told officers he was not involved in the shooting and was riding south to purchase fuel.

Deputies stopped Huskey on Birch Bay Lynden Road near Kickerville Road at about 8:15pm. Huskey possessed a 9mm handgun and stated to deputies that he fired the weapon during the confrontation.
Both men were booked into the Whatcom County Jail by the Whatcom County Sheriff’s Office.
Huskey currently faces the following charges in Superior Court.
- 3 counts of 1st-degree assault (felony)
- reckless endangerment (gross misdemeanor)
Mayne De Isla Puga currently faces the following charges in Superior Court.

- making a false or misleading statement to a public servant (gross misdemeanor)
During initial arraignment hearings on September 8, 2026, prosecutors requested bail be set at no bail or $1 million bond with no cash alternative for both men. The court set bail at $1 million bond with no cash alternative.
As of September 9, 2026, both men remain in custody in the Whatcom County Jail pending being able to post $1 million bail.
The next court hearing is scheduled for September 17, 2026.
