FERNDALE, Wash. — Rosalio Lawerence Todd, age 24, of Ferndale, pleaded guilty earlier this month to 2 counts of 2nd degree assault with a firearm, felony harassment and attempting to elude a police vehicle in Whatcom County Superior Court. The charges were the result of multiple incidents.
Todd was arrested September 20, 2019, following a drive-by shooting incident in Ferndale 4 days earlier in which a car containing 4 people was hit by a gunshot during what the victims called a road rage incident.
Todd was also arrested May 14, 2021, after Washington State Patrol trooper spotted a vehicle he was driving southbound on I-5 from Portal Way traveling over 100mph. After the trooper activated the patrol vehicle’s emergency lights, the vehicle’s speed increased to near 140mph. The vehicle then “heavily braked” and came to a stop on the Slater Road off-ramp. The passenger said Todd had previously been going northbound and southbound on I-5 at high speeds that night.
The felony harassment charge followed an incident on July 28, 2021, when Todd threatened family members with a box cutter and a machete and then fled by jumping over fences in the neighborhood.
The judge sentenced Todd to the following according to court records.
- 2nd degree assault with a firearm – 51 months in custody for the first count and 15 months for the second followed by 18 months and 12 months parole respectively
- Harassment by threatening to kill and/or do bodily injury – 12 months in custody followed by 12 months parole
- Attempting to elude a police vehicle – 6 months in custody and eligible for in- and out-of-custody work crew, work release and electronic home detention
All the sentences will be served concurrently with credit for time already served in custody granted. A 10-year no contact order was also issued between Todd and several of the victims.
