WSP alerts drivers – filming while driving is illegal

WHATCOM COUNTY, Wash. — Washington State Patrol reported today, March 5, 2026, at a recent collision scene, nearly 100 drivers over less than 1 hour were seen pulling out their smartphones to record the scene. This action qualifies as using a personal electronic device while driving, a traffic infraction. Citations carrying a $150 fine were sent in the mail.

It’s illegal to hold your phone while driving — including to film a collision scene.

Troopers recently ticketed drivers doing exactly that. Slowing down to record causes traffic backups and more collisions.
