BELLINGHAM, Wash. — A 21-year-old man was arrested after Lummi Nation Police officers found him in a vehicle with an underage girl who told officers she had been sexually assaulted while being held against her will.
According to an affidavit of probable cause filed by prosecutors in Whatcom County Superior Court, a Lummi Nation Police Department (LNPD) officer came upon a parked vehicle blocking a beach access road in the 2600 block of Lummi View Drive after 2am on December 10th. A male driver and female passenger in the vehicle were contacted.
The driver was identified as Eugenio Duenas Herrera aka Eugenio Herrera-Duenas, age 21.
The passenger told a second officer she had been held there against her will and the driver had sexually assaulted her. She added that the driver had showed her a firearm. The officers located and removed the firearm. It was then determined to have been reported stolen in an August 2023 burglary investigated by LNPD.

Herrera was arrested and booked into the Whatcom County Jail.
As of December 28th, Herrera remained in custody at the Whatcom County Jail pending being able to post a $200,000 bond or $20,000 cash bail. He currently faces the following felony charges in court.
- 3rd-degree rape without consent
- 3rd-degree rape of a child
- 1-degree unlawful possession of a firearm
- possession of a stolen firearm
Herrera has prior felony convictions for residential burglary and unlawful possession of a firearm. He pled guilty in July to 2nd-degree unlawful possession of a firearm and sentenced to 8 months in custody with credit for time served. That charge resulted from a 2022 drive-by incident in Bellingham when he was 19 years old.
