FERNDALE, Wash. — A Whatcom County Sheriff’s Office deputy reportedly observed a vehicle run a stop sign at the intersection of Northwest Drive and W Axton Road about 1:30am on Sunday, October 6th, and conducted a traffic stop.
According to an affidavit of probable cause filed in Whatcom County Superior Court, the vehicle pulled over for the deputy. While the deputy was speaking with the driver, he observed rifle with a short barrel on the floor of the back seat. The driver said it was a pistol and consented to a search of the vehicle.
The search uncovered the following items.
- a 12-gauge shotgun with a 15.5″ barrel
- a 22-caliber rifle with a 10″ barrel
- 22-caliber ammunition
- 1.7 grams of suspected fentanyl
- 4 grams of suspected methamphetamine
- glass pipe with drug residue
Both weapons were reportedly loaded with a round in the chamber.
As a convicted felon, the man, identified as Leroy Guillen, age 71, is unable to legally possess firearms.
He was arrested and booked into Whatcom County Jail charged with driving while his license was suspended, unlawful possession of firearms and 2 counts of possession of unlawful firearms. According to jail records, a charge of possession of controlled substances was not filed in the court.
At a preliminary hearing on October 7th, bail was set at $15,000 bond with a $1,500 cash alternative.
As of October 9th, Guillen remained in custody at the jail. An arraignment hearing is scheduled for October 18th.
