Charges dismissed against Blaine man suspected of fatal shooting, competency cited

BLAINE, Wash. — Wayne Harold Mahar, Sr, age 76, faced a 1st-degree murder charge in Whatcom County Superior Court following an incident where he was suspected of having shot and killed a neighbor he claimed had been harassing him. That charge was dropped on March 29th after the court determined he lacked the capacity to understand the legal proceedings nor could assist in his defense.

The court took into consideration the testimony of 2 doctors who conducted forensic competency evaluations following evaluations of Mahar and who “reached the same medical conclusion.”

Prior to the case dismissal, Mahar was being held at Western State Hospital. He was ordered to remain there for up to 120 hours for further evaluation as part of the order dismissing the charge.
