Suspect in shooting of Lummi Nation Police officer makes court appearance

FERNDALE, Wash. — The man arrested suspected in the shooting of a Lummi Nation Police officer on Monday ,July 28, 2025, made his first court appearance today, July 30, 2025.

Following the court appearance, the Whatcom County Sheriff’s Office (WCSO) issued the following statement.

The suspect in the shooting of a Lummi Nation Police Officer early Monday morning, July 28, had his first appearance in Whatcom County Superior Court today, July 30. He was ordered to be held without bail.

The suspect, who was known by a different name when he was arrested, was subsequently identified as Jesus Penualas-Agramon by his fingerprints upon booking. Penualas-Agramon is a Fugitive from Justice out of Colorado and is wanted for a parole violation for Dangerous Drugs and Possession of a Firearm.

Penualas-Agramon was arrested on Attempted Murder 1st, Unlawful Possession of a Firearm, and Possession of a Stolen Firearm in addition to three counts of Delivery of a Controlled Substance-Fentanyl and Money Laundering. He fired multiple shots at the officer in an unprovoked attack, causing several injuries. The officer received immediate emergency medical care and has since undergone surgeries. He remains hospitalized.

“This has been a long and very difficult two days as our brother officer begins the slow journey of recovering from his injuries,” said Whatcom County Sheriff Donnell “Tank” Tanksley. “Our   hearts are with the officer, his family, Lummi Nation PD and the greater Lummi Nation community.”

The investigation to date has revealed:

  • On July 28 at 12:52 a.m., the Lummi PD officer came upon a white Ford Ranger nose-down in the ditch in the 3200 block of N. Red River Rd. 
  • The Officer went to check the driver of the truck to see if he was injured.  The driver was getting out through the passenger side window.
  • The driver climbed up out of the ditch, saw the officer, took a step away, pulled up a semi-automatic handgun, and fired at least 10 shots at the officer hitting him seven times.
  • The officer was in full uniform, driving a fully marked Lummi Nation Patrol car.
  • The suspect fled the scene and ran to the nearby residence of an acquaintance and was given a ride out of the area.
  • A handgun and shell casings were recovered from the scene. It is unknown at this time whether the firearm is the weapon used in the assault.  However, the recovered firearm was determined to be stolen from a Whatcom County resident.
  • From the officer’s body cam footage, detectives recognized the suspect as one known to them at the time as Javier Pena-Flores.
  • Detectives learned the suspect was at a friend’s residence in Ferndale.
  • Surveillance revealed the suspect coming in and out of the apartment.
  • SWAT team members arrived, contained the area, and ordered the suspect to exit with his hands empty and in the air.  The suspect eventually emerged and was taken into custody without incident.
  • The suspect received medical treatment for injuries sustained in his truck crash at PeaceHealth St. Joseph Medical Center. He was then booked into the Whatcom County Jail for the charges mentioned earlier.
