MAPLE FALLS, Wash. — A Whatcom County Sheriff’s Office (WCSO) deputy working in Maple Falls on April 27th recognized a red Mitsubishi Mirage being driven by a man with a warrant for his arrest for suspicion of possession of a stolen vehicle. The deputy stopped the Mitsubishi and told the driver he was being placed under arrest.
An affidavit of probable cause provided by WCSO and filed by the Whatcom County Prosecutor’s Office in Whatcom County Superior Court said the driver, identified as Zachariah Angus Magee, age 27, physically resisted arrest and kicked the deputy as he fought to get away. The deputy then took Magee to the ground and placed him into custody.
While Magee was being placed in the back of the deputy’s patrol vehicle, he spit on the deputy. While in the back of the patrol vehicle, he kicked out the plexiglass screen between the front and rear seats making it impossible to transfer him via the patrol vehicle.

As a result of the warrant and the assault and damage that occurred while being arrested, Magee was booked into the jail charged with suspicion of assault, resisting arrest, malicious mischief and possession of a stolen vehicle.
As of April 29th, Magee remained in custody pending being able to post a $5,000 bond or $500 cash according to jail records.
